Did you know that you can't be terminated for having arthritis if you can still do your labor?

Friday, February 3rd, 2012

The North Americans with Disabilities Act (ADA) and the Californian dept of the Fair Employment and Housing Act (FEHA) state that an employer can in no way take any action that may be negative to the employee based on the grounds of their arthritis. This will include the following:

– Not allowing time off the job for Doctor’s appointments and medical exams
– No accommodation by the employer so that the worker is afforded reasonable time off from work for their illness
– Non allowance of regular breaks to rest the affected joints of the disabled party
– No arthritic friendly equipment is supplied by the employer such as a straightforward use keyboard or rheumatism friendly chair.

A talented wrongful termination lawyer who understands disability rights can be called on to battle in your corner especially if there's a hostile work environment. As touched upon earlier some bosses may not make it appear so apparent re the reasons that they have ended the worker, saying underlying reasons like not being up to the job, or consistently taking time off. This is something that an attorney will see straight through and will make the claim on behalf of their client in an appropriate way.

According to the letter of the law an employer has to live by something known as ‘reasonable accommodation’. This means that there properly must be a certain amount of flexibility when employing a disabled person. This could relate to allowing time off for medically based reasons, making them as comfy as possible so the arthritis sufferer can carry out the task in hand to the best of their ability, or maybe creating a position for them (if applicable).

The law is there to guard staff from companies who do not provide these services. One critical factor to bear in mind is if a worker can't perform the fundamental functions the job entails, then they don't have grounds for a legal claim.

For any person attempting to work with a devitalizing illness such as arthritis, it can be a punishing and painful experience. However with the right employer to back you, it'll feel just that bit easier. For those employees who don't have that backing, bear in mind that a talented team of wrongful termination lawyers can be helpful.

Rheumatoid arthritis doesn’t have to hold you back in the office so take care you know your rights

Thursday, February 2nd, 2012

If you're an osseous rheumatism subject and have been dismissed from your job under false pretences then it's great to understand that you have grounds for recourse. Most pain can be managed but there are times when a sufferer will have to take time off from work and find the information of a doctor, particularly when the pain becomes unmanageable.

It is fair to think that in this day and age that we are living in an equal opportunities society and that disabled people (however they may be) are treated in a fair and just demeanour by their companies. However the truth of the affair is that some bosses still wrongly feel that disabled folks are a hindrance in the workplace and will use adverse tactics so that the disabled employee will either give up themselves, or are dismissed by the employer for reasons that won't seem wonderfully clear. If this is the case, then wrongful termination lawyers Los Angeles can help.

So the way in which the hostile workplace environment laws defend you?

Firstly in order to provide defence against the law, and file a wrongful discrimination case because of their incapacity, the rheumatoid arthritis suffer must be well placed to prove that they are indeed disabled, or have a record of being disabled. This being so then they're going to have to show the following

That their incapacity limits them from carrying out certain physical jobs

That they can in reality perform the fundamental tasks of the job

The employer took some kind of unfavorable action like terminating, suspending, demoting or not promoting the worker on the grounds that they were indeed disabled.

Some older workers think that they are coerced into early retirement before they are ready

Monday, October 24th, 2011

The question of whether to retire isn’t always an easy one. Some older employees feel that they are really forced into an early retirement because they either can't find a job, or they are not being promoted or fully utilised in their present role. Many elderly workers do not really wish to retire at a young age, and like to remain an active part of the labor pool. They feel healthy in body, mind and soul and they notion of not working doesn't appeal to them. But we're a society that values youth, and it is not just in the head’s of older workers that discrimination against them exists. The good news is that discriminating on the basis of age at work is illegal under both the Federal Age Discrimination in Work Act (ADEA), and the California Fair Employment and Housing Act (FEHA).

Under both laws, there are some special constraints on who can sue. (For general constraints on who can sue and be sued, see California Fair Work & Housing Act.)

People under forty years of age are not protected by age discrimination at work laws. If an employer will not hire somebody because he or she is thirty-nine (and therefore “too young”), that is not illegal. However , if an individual isn't employed because he or she is forty and “too old”, this is illegal and a legal action can be brought against the company.

Age discrimination has some special aspects which make it different from other kinds of employment discrimination. A few of these are debated below.

Golden Handshakes

Sometimes when companies are down-sizing, they lay folks off by offering “golden handshakes”, which are special packages to staff who agree to take early retirement. This is not age discrimination. Nevertheless if it is being done for the purpose of losing older employees just because of their age, and if it can be shown that there's a genuine discriminatory motive, this is not legal.

Replacing Older Employees

It is illegal to replace someone over 40 with someone under forty, if age is the reason. It is also illegal to replace an individual over forty with a younger individual who is also forty.

Older Worker’s Benefit Protection Act

The Older Worker’s Benefit Protection Act provides protection of benefits or benefit packages for older employees. According to the act, an employer must provide identical benefits for older workers as they do for their younger opposite numbers. An employer can do this by either providing packages that are equal in benefit or by spending the same quantity of money on every person. An individual cannot relinquish his right under this act, unless that waiver is knowing and voluntary.

Replacing Higher Earners and Age Discrimination at work

It's not illegal to replace folks that are making high wages with people who will make less because they have less seniority.

However , this usually means replacing older staff with younger ones. If the wage points to consider are not the real motivator, and the employer is actually attempting to replace older employees with younger ones, this isn't legal. Here, the worker must prove that it is the age, not the wages, which is motivating the employer to fire the older workers.

Ideas That May Help Reduce Lumbar Pain

Thursday, October 21st, 2010

Back pain is the most common health issue that troubles most adults. It’s important to identify the causes and factors in order to find relief or treatment for back pain.

Age plays a significant part in the overall health of a person. Older people experience more bouts of back pain because of the normal weakening of the bones and muscles.

Posture is important in preventing back pain. A person who works in an office and sits down at a desk the majority of their day, are more likely to have back pains. If you maintain the proper seating and use the correct type of chair, it will help to reduce the discomforts in the back.

Keep an eye on your weight s that you are not contributing to your back aches. Carrying extra weight on your body leads to knee and joint problems as well. It would help to stay on the leaner side and watch your diet so that you can maintain overall health and free yourself from back pain.

Lack of exercise also becomes a factor in back aches. If back muscles or any muscle for that matter, are not being used, toxins tend to accumulate which are the cause of those aches and pains we experience.

Now at the same time, too much strain from bending and overworking those muscles can put too much pressure on the back muscles. This is especially true for the lower and upper back area.

Try to lessen your chances of developing back pains by regular exercise or going on a daily walk. However you decide to exercise your muscles is fine; just make sure you don’t keep your muscles inactive.

These bodies of ours need constant motion to stay well oiled and greased. Without this constant motion, our joints and bones kink up and there is where the aches and pains come from.

The Thrill Of An Upcoming Retirement

Monday, September 13th, 2010

No matter how thrilled you are about your approaching retirement, and the feeling of liberty and independence that it is bringing along, do not let yourself miss out on the important step of making plans about your future.

Usually the main concern for people who have just reached retirement is that of being able to have a dependable source of income, so that they can have the kind of lifestyle that they are accustomed to. However, being able to maintain similar levels of income like before retirement may not be enough for looking after the needs of the whole family.

To begin with, you should find out about your insurance expenses and whether they would be enough during your retirement period. If not for long, they should at least be enough to keep you comfortable till you start getting medical benefits.

The next step is to sit with your partner and discuss in detail the finances, so you can come up with a budget for the retirement period. While doing so, make it a point to listen to your partner and ask for his or her advice. This can only work well with the consent of you both, and would definitely lead to better results.

While you are making plans with your partner about the future, you might as well make some for your own self. There is absolutely nothing wrong with that, as you may have a few individual goals or desires that you would like to pursue.

To ensure that your plans see the light of the day, you will have to plan your finances and time in such a way that it suits both of you.

Most importantly, keep a record of your bills, including the totally annoying credit cards that never seem to end and student loans. It is always wise to clear them up with time, instead of waiting for it to sum up in a huge amount.

Lastly, take care of issues related to ones security and property, by paying for your house and all the taxes, so that you do not have to face any difficulties later.

Fabrics For Home Decorating Use

Tuesday, March 16th, 2010

Cloth or cloth is a very effective material to make use of when decorating your room, office or home, if you want to create a warm, inviting or themed atmosphere. It is simpler to use materials because they come in so many different patterns and colours and it is inconceivable that you will not be abe to find a textile to suit your decorating needs.

Textile can have many applications in home decoration, some of them are as wall coverings, as in flock, slip covers, carpets, table runners, curtains and wall hangings. A room without textile can look cold and unappealing.

It is best to have a definite style in mind, before you go buying your materials. For example, do you already have furniture? Do you already have a few pieces of furniture? If you do, are they all of a comparable style? If they are, then the fabrics you choose have to fit in with them. Otherwise, you can use material to harmonize unmatched furniture.

For example, if you have a harmonized set of furniture, but you want to add a reclining chair, you could get a slip cover for that recliner chair which will make it better fit in with your existing decor, rather than have it stick out like a sore thumb.

If you are beginning from nothing it is even easier. You can select a theme or a style and purchase fabrics that will match in with that style. For example, you could choose a Southern style or an Italian, say, Tuscan style. If you want a Tuscan style, you might choose to select materials with woven textures such as burlap, fabrics made from the abaca fiber and fabrics made from banana tree fibres, Savannah cloth and tobacco leaf fibres.

Tuscan decorating fabrics tend to be heavier but they are very versatile. If you use the Tuscan theme as your guide, these decorating materials could be used for blinds, runners, curtains, slip-covers and rugs. However, you may decide on a cottage style decor, in which situation you will select floral patterns in light, bright colours.

You have so much variety when you use fabrics to customize your room or home. Having said that, I would like to emphasize that you ought to take your time before coming down on a theme, because if you implement a theme or colour scheme correctly, it can be quite expensive , which means that you will have to live with it for quite a while.

If you have the money, it would be fun to have two or more themes, all somewhat different that you could swap over from time to time, say, when one theme is in the wash. Curtains and slip covers could go in the laundry together and be replaced by a completely different theme for six months or so.

What Is An Ergonomic Office Chair?

Sunday, March 14th, 2010

Before you go out and purchase a chair for your office because you like the appearance of it, you should appreciate that not all chairs are the same. An office chair should be seen as a piece of health and safety equipment, although that does not mean that it does cannot be attractive too. I will explain what you should look for in an office chair over the next few paragraphs.

The most essential aspect of any chair that you will have to use for a lengthy period of time is the height of the seat itself off the floor. You most restful long-term seated posture is with your thighs parallel to the floor and your feet flat on the floor. If you cannot find a chair to suit your proportions or if the chair will be used by several people, then you will have to obtain an adaptable one.

The chair should be adjustable while you are sitting on it in order to make sure that you get it correct. The old fashioned technique was to wind the seat up or down on a screw by revolving it round and round. The modern method is to pump it up hydraulically.

There has to be a back to the seat, a stool is no good for long term seating. The back rest should incorporate a lumber support. This lumber support ought to be adjustable too. It must go up and down, but some can be inflated as well. The back rest should also extend to the head, if it does not suit, then there should be an adjustable head rest. Often there is a tilt mechanism, which permits the sitter to assume different postures for short lengths of time.

This is a feature of chairs called recliners. If you go for a recliner, make sure that the base is stable, so that you do not go over. A five-pronged star shaped base is the most common design, but there are others too. The base is usually on five casters to preclude the need to stretch and lean, if you have to get to a near-by filing cabinet.

The seat or the seat pan is important. These are adaptable on some more expensive chairs, but it is better to test these features ‘for fit’ on those that are not. The leading edge of the seat should be rounded so as not to interfere with your circulation. For the same reason, there should be a decent gap between the leading edge and the back of your knees.

The seat should be at a comfortable incline, one that suits you. Most chairs have seat pans that are parallel to the floor, which suits most people, but a reclining chair solves this problem automatically, as they recline forwards and backwards. The fabric of the seat should be one that breathes and is comfortable. This is one of the reasons why leather is favoured. It should also be padded and easily cleanable.

While not absolutely necessary, arm rests can be convenient for reading or taking a few minutes rest. Good arm rests will be height (and some even width) adjustable. With your arms by your sides, the arm rests should come up to your elbows.

These pointers are given in order to reduce the possibility of strain and injury to those who spend many hours at a time working at a desk.

Using Soft Skills As An Employment Enhancer

Tuesday, March 9th, 2010

Individuals with limited exposure to the world of work may lack the “soft skills” needed to get a job, stay employed, and advance. Soft skills are the nontechnical skills, abilities, and traits that workers need to function in a specific employment environment. They include four sets of place of work competencies: problem-solving and other cognitive skills, oral communication skills, personal qualities and work ethic, and interpersonal and teamwork skills.

In addition, post-employment activities, such as case management, support groups, mentoring, and job coaching, provide opportunities to work on soft skills based on clients’ work-related experiences. One challenge for agencies is to assess and document soft skills. Agencies can market their soft skills training to employers and work with local employers to develop standards for job readiness.

There are several soft skills available out there for people to take advantage of, to add to their technical skills and make themselves more applicable and adaptable in the work place. For individuals looking at building a career in the building and construction industry some of the soft skills below would be suitable: – Defensive Driving – Fall Safety – Forklift Safety – Having an Effective Safety Committee – Hazard Communications – Hazard Identification – Hazardous Energy Control – Hearing Safety – Job Safety Analysis – Work zone Safety

Further more for individuals who are in the service delivery industry and hoping to build a career, some of these soft skills might come in handy: – Call Center Training: Sales and Customer Service Training for Call Center Agents – Business Ethics for the Office – Customer Service: Critical Elements of Customer Service – Marketing and Sales – Mastering the Interview – Motivation Training: Motivating Your Workforce – Skills for the Administrative Assistant – Team Building: Developing High Performance Teams – Teamwork: Building Better Teams – Telemarketing: Using the Telephone as a Sales Tool – Conducting Effective Accident Investigations

Programs for entry-level workers and supervisors that emphasize the soft skills needed for sustained employment. These programs teach cognitive and behavioral skills that provide workers and supervisors with the insights and skills to resolve work-related problems and succeed in social interactions.

Most companies are now currently putting together structured processes for their staff to enhance their soft skill knowledge. These companies would rather they are employing individuals already with the soft skill knowledge hence the current drive to get job seekers to acquire soft skils

Soft skills might be trivialized now but in the months to come they will be a requirement for Job placements. The need to start getting soft skill training is very important and can not be over emphasized. All employees who lack soft skill training will be in limbo when the skill is required from them.

Whale Trainer Killed In Killer Whale Attack At SeaWorld Orlando

Saturday, March 6th, 2010

Tilikum, a 5 tonne orca has killed it’s trainer by dragging her into the pool and thrashing her underwater. The event occurred at SeaWorld Orlando as the trainer, Dawn Brancheau was chatting with visitors after a show. Onlookers said the whale “thrashed her all around” and pulled her under the water.

Police state that Brancheau “slipped and fell” into the tank but over 50 witnesses confirm that the event was no accident, the trainer was reportedly stroking the whale before it swam away and darted back grabbing the trainer out of the air in its mouth before shaking her violently underwater.

Brancheau, a 40 year old who was married with no children, was an experienced whale trainer and had previously commented on the dangers involved with her job, “You can’t put yourself in the water unless you trust them and they trust you.” After a visit to SeaWorld at the age of nine, Brancheau had dreamt of working as a whale trainer.

30 year old Tilikum, whose name means ‘fierce’ in the native Indian Chinook language, had reportedly acted abnormally and did not react to directions in an earlier show. Trainers had previously been forbidden from swimming with the animal because of its variable temper. Questions are being raised as to whether the 5 tonne killer whale should be allowed to continue working near humans as it is the third fatality he has been linked to.

In 1991 Tilly was blamed as one of three whales behind the death of a trainer at Sealand of the Pacific in Victoria, British Columbia and in 1999 the body of Daniel Dukes was found in Tilly’s tank after policed had determined the man sneaked into the compound at night.

General Manager of SeaWorld, Dan Brown, had to hold back tears while he stated that the company’s safety procedures will be an enquiry into the safety procedures while the park remains closed and shows at their other shows are cancelled.
